How to Get a Divorce in Rhode Island

Divorce may or may not have been a difficult decision for you, but once you have decided to make the decision, you may be wondering what steps to take next. At The Law Office of Patricia A. Sullivan, I can walk you through the legal process.

Grounds for Divorce

In Rhode Island, a divorce will either be deemed "no-fault" or "fault." There must be grounds for divorce, and a no-fault divorce would include grounds such as irreconcilable differences or living separate for at least three years. A fault divorce may have grounds such as:

  • impotency
  • adultery
  • cruelty
  • desertion
  • many others

If you are the one wishing to obtain a divorce, then you are the Plaintiff in the case. The non-filing spouse is considered the Defendant. Rhode Island is an equitable distribution state, which means that all property will be divided based on fairness, rather than equally.
